Why Am I Using My Own Collision Coverage When the Other Driver Is Fully at Fault?
Many clients ask:
Browse the insurance glossaryMany clients ask: "The other driver is 100% at fault—why is my insurance company telling me to go through my own collision coverage?"
The reason: In Ontario, in most cases 🔹 Your own insurance company handles your claim first 🔹 Then recovers the costs from the other driver's insurer through an internal system
This is called the Direct Compensation – Property Damage (DCPD) system.
However, if: * The other driver flees the scene * The other driver is uninsured * The accident occurs in a parking lot and fault cannot be determined
Then your claim may be processed under Collision or Hit & Run coverage instead.
📌 Key point: Whether the other party is 100% at fault is not decided by you—it is determined according to the Fault Determination Rules. Don't just rely on "I wasn't at fault"—look at the rules.
