Ontario DCPD: When to Claim Vehicle Damage from Your Own Insurer

DCPD applies when an accident takes place in Ontario and at least one other involved automobile is insured under a motor vehicle liability policy issued by an insurer licensed in Ontario or one that has filed with FSRA to provide this coverage. When you are not entirely at fault, you claim covered damage to your automobile, its contents and loss of use from your own insurer.
Electing Not to Recover Under DCPD
You may elect not to recover damages under DCPD by providing written confirmation to your insurer. If you make this election, you cannot recover DCPD damages and your insurer cannot offer or issue Collision or Upset coverage.
